Scott was asked to shut off his vehicle and step out to which he denied at first, but stepped out when asked again. At this time he told the officer that he had his handguns on him and they were removed. Scott stated that he had four beers and had just left Rookies Sports Bar. The officer asked him if he would do a couple of tasks to make sure he was safe to operate a motor vehicle to which he consented and performed poorly. Scott was read implied consent and agreed to a breath sample, the result of which was .17 blood alcohol content.
